Education Services for Overseas Students (ESOS) Act

ESOS is the legal framework sets out the registration requirements and the outgoing standards for education providers that offers courses to overseas students, as well as for the provision of the education services to them. This framework provides a stable national procedure to the registration of the education providers so that the standard of the training and the care of students remain leading.

The primary focus of the Education Services for Overseas Students (ESOS) Act is to:

§  Complement Australia’s migration laws by ensuring providers collect and report relevant information relating to student visas.

The Education Services for Overseas Students (ESOS) framework protects the rights of international students, comprising:
§  You’re right to sign a written agreement with your institution before paying fees, fees payable, and information about refunds of course money and setting out the services to be provided. Always keep a copy of your written agreement.
§  Receiving current and accurate information about your course, modes of study, fees and other information from your institution and institution’s agent before enrolling
§  Placement and refund service for international students, which is activated in the event that your institution is unable to teach your course.
The role of the Institution:
In offering education and training services to international students ESOS framework establish standards that the Australian institutions must meet, consisting: 
§  Orientation and access to support services to help you study and adjust to life in Australia.
§  Contact details of officers available to help international students.
§  When your enrollment can be deferred, suspended or cancelled.
§  If attendance will be monitored for your course.
§  A complaints and appeals process.

The role of the Overseas Student:
§  Maintain your Overseas Student Health Cover (OSHC) for the period of your stay
§  Meet the terms of the written agreement with your institution
§  Satisfy your student visa conditions
§  If you change your address inform your institution
§  Maintain satisfactory course progress
§  You have to follow your institution’s attendance policy if attendance is recorded for your course

§  You have to maintain your approved accommodation, support and general welfare arrangements if you are under 18
